Welcome to PetalPost! These Terms of Service ("Terms") govern your use of the PetalPost desktop application, cloud platform, and related services (collectively, the "Service") provided by Petal Post LLC ("we," "our," or "us").
By downloading, installing, or using PetalPost, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The short version — in plain English
PetalPost is software you subscribe to. We help you run your shop — we don't take your customers' payments.
You need to be 18 or older, keep your login safe, and you're responsible for what happens in your account.
There's a 30-day free trial, and no card is required to start.
We work hard to keep things running and your data safe, but we can't promise it's perfect — use it at your own risk and keep your own backups too.
If something goes wrong, there's a limit on what we owe you (see section 9).

1. Account Registration
You must be at least 18 years old to use the Service
You must provide accurate and complete registration information
You are responsible for maintaining the security of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account
One person or business may not maintain multiple free accounts
2. Free Trial and Free Tier
PetalPost offers a 30-day free trial with full access to all features:
No credit card required to start your trial
Full access to all Professional tier features during trial
Trial begins upon first installation and account creation
After trial expiration, you will be moved to the FREE (Starter) tier
You may upgrade to a paid plan at any time during or after the trial
Important: The FREE (Starter) tier is provided at our discretion and may be modified, limited, or discontinued at any time. We will provide at least 30 days' notice before making material changes to the free tier. If the free tier is discontinued, you will have the option to export your data or upgrade to a paid plan.
3. Subscriptions and Payments
3.1 Subscription Tiers
Tier names, features, and prices vary by account type (florist or wholesaler) and are listed on our pricing page at petalpost.shop/plans. In summary:
Free (Florist Free / Wholesaler Starter): Basic features, limited to essential functionality (subject to change; see Section 2)
Standard (Florist Plus / Wholesaler Pro): Expanded features and higher usage limits
Premium (Florist Pro / Wholesaler Enterprise): Full feature set, multi-location support, and priority support
3.2 Billing
Subscriptions are billed monthly or annually in advance
Payments are processed securely through Shopify (our merchant of record)
Prices are in USD unless otherwise specified
We reserve the right to change prices with 30 days' notice
3.3 Refunds
Monthly subscriptions: Refunds within 7 days of charge if unused
Annual subscriptions: Pro-rated refunds within 30 days

4. Acceptable Use
You agree NOT to use the Service to:
Violate any laws, regulations, or third-party rights
Scrape websites that prohibit automated access in their Terms of Service
Collect personal information about individuals without consent
Interfere with or disrupt the Service or connected servers
Attempt to gain unauthorized access to any systems
Use the Service for any fraudulent or deceptive purposes
Reverse engineer, decompile, or disassemble the software
Remove or alter any proprietary notices or labels
Resell or redistribute the Service without authorization
Transmit malware, harmful code, or spam
5. Web Scraping Features
PetalPost includes features for automated data collection. You acknowledge and agree:
You are solely responsible for ensuring your scraping activities comply with applicable laws
You will only scrape websites where you have authorization or where such activity is permitted
You will respect robots.txt directives and website Terms of Service
PetalPost maintains a blocklist of prohibited sites; attempting to circumvent it violates these Terms
We may suspend accounts that engage in prohibited scraping activities
You indemnify PetalPost against any claims arising from your scraping activities
6. Intellectual Property
6.1 Our Intellectual Property
The Service, including all software, designs, text, graphics, and other content, is owned by Petal Post LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes.
6.2 Your Content
You retain ownership of your business data, including products, orders, and customer information. By using the Service, you grant us a limited license to process this data as necessary to provide the Service.
6.3 DMCA Compliance
We respect intellectual property rights and respond to valid DMCA takedown requests. To submit a takedown notice, contact us at support@petalpost.shop.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You are responsible for the data you upload and must ensure you have the right to share it with us. We process your data as described in our Privacy Policy and in accordance with applicable data protection laws.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of any data collected through the Service.
You use the Service at your own risk. You are solely responsible for any damage to your computer system or loss of data.
9. Limitation of Liability
To the maximum extent permitted by law, Petal Post LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless Petal Post LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your web scraping activities
11. Termination
You may terminate your account at any time through account settings
We may suspend or terminate your account for violation of these Terms
We may terminate the Service entirely with 30 days' notice
Upon termination, your right to use the Service ceases immediately
Your local data remains on your device after termination
You may export your data before termination where technically feasible
Sections 6-10 survive termination of these Terms
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
13. General Provisions
Governing Law: These Terms are governed by the laws of the State of Idaho, USA
Dispute Resolution: Disputes shall be resolved in the courts of Kootenai County, Idaho, and you consent to the personal jurisdiction of such courts
Severability: If any provision is found unenforceable, the remaining provisions continue in effect
Waiver: Our failure to enforce any right does not waive that right
Entire Agreement: These Terms constitute the entire agreement between you and Petal Post LLC
Assignment: You may not assign these Terms without our consent
14. B2B Trade Credit Between Users
PetalPost lets a business buyer request, and a business seller grant, net payment terms (trade credit) directly between the two businesses. PetalPost is a software platform only. PetalPost is not a party to, lender under, guarantor of, or collections agent for any such net-terms or trade-credit relationship between users of the Service.
All credit decisions, credit limits, payment terms, late fees, disputes, and collection are solely between the buyer and the seller. PetalPost does not extend credit, does not underwrite or approve any credit request, does not guarantee payment, and does not collect debts on any user's behalf. You are responsible for your own compliance with any laws applicable to extending or receiving trade credit.
